Chapter 7 Bankruptcy

Creditor harassment, threatening letters, foreclosure notices and past-due bills can overwhelm your life. However, it is possible to get a fresh financial start by filing for bankruptcy protection.

As a Texas bankruptcy attorney and founder of the Law Office of Gordon Mosley, I understand that a bankruptcy filing is not a decision to take lightly. That is why I provide clients with the guidance and understanding that comes with more than 20 years of legal experience. Debt relief may be easier than you think.

How Does This Help?

Chapter 7 bankruptcy is also known as liquidation bankruptcy. This means that most of your debt will be discharged if you qualify for this type of protection. Many people mistakenly believe that they will lose their homes and other assets if they file for Chapter 7.

However, the reality is that you will likely be able to protect most of the assets that you own outright. A Chapter 7 filing is useful for discharging substantial credit card debt, medical debt and other eligible forms of debt.

Do I Qualify?

In recent years, Congress has tightened the requirements for qualifying for Chapter 7 bankruptcy. However, this does not automatically make you ineligible. In order to qualify, the court will evaluate your gross income from the previous six months.

If your income is below the median gross income according to your family size and geographic location, you will likely qualify for this form of debt relief.

What is bankruptcy?

Bankruptcy offers an individual or business a chance to start fresh by forgiving debts that simply cannot be paid while giving creditors a chance to obtain some measure of repayment based on the individual's or business's assets available for liquidation.

In theory, the ability to file for bankruptcy benefits the overall economy by allowing people and companies a second chance to gain access to credit and by providing creditors with a portion of debt repayment.
